Investing in Florida

What's different about investing in Florida

Florida added 467,347 residents between 2023 and 2024, the second-largest gain of any state, and passed 23 million people (U.S. Census Bureau, Vintage 2024). For investors in Miami, Tampa, Orlando, Jacksonville and Fort Myers, that growth means steady rental demand and active flip markets. It also brings Florida-specific rules worth understanding before you choose a loan. LOANKWEST is a loan broker, not a lender. We take one application and present your Florida deal to the lenders in our network that fit it.

Foreclosures go through the courts. Florida law requires all mortgages to be foreclosed "in equity," meaning a judicial process rather than a trustee sale (Fla. Stat. § 702.01). For investors, this matters in two ways. Distressed and pre-foreclosure opportunities tend to move on a court calendar, and if you are the one holding a maturing loan, there's usually time to arrange a refinance or bail out funding before a sale. Don't wait for the court date to start.

Local governments can't impose rent control. Since the Live Local Act took effect on July 1, 2023, Florida statute says a county or municipality "may not adopt or maintain in effect any law, ordinance, rule, or other measure that would have the effect of imposing controls on rents" (Fla. Stat. § 125.0103(2); the same rule applies to municipalities under § 166.043). For DSCR investors, this means underwriting rent growth is a market question, not a regulatory one.

There's no state personal income tax. Florida's constitution bars a state tax on the income of resident individuals (Fla. Const. Art. VII, § 5). Many investors and self-employed buyers relocating to Florida have income that's hard to document on a traditional application. That's exactly what DSCR loans (qualify on the rent) and asset-based hard money are built around.

International buyers are a big part of the market. Florida had the largest net international migration gain of any state in 2024 (411,322; U.S. Census Bureau, Vintage 2024). LOANKWEST's Foreign National DSCR loans require no U.S. credit score or SSN, and the program pages are available in Spanish and Chinese.

Top Florida markets for investors

  • Miami High-value condo, luxury and mixed-use; strong foreign-national buyer activity.
  • Orlando Short-term vacation rentals and single-family rentals near the tourism corridor.
  • Tampa Fast-growing single-family rental and fix & flip market.
  • Jacksonville Lower entry prices and a large single-family rental base.
  • Fort Lauderdale Coastal condos, small multifamily and value-add.

Florida foreclosure, rent-rule and closing-cost basics

Foreclosure process
Judicial (court case) Florida mortgages are foreclosed in court (Fla. Stat. § 702.01), so timing depends on the local court docket and on whether the case is contested.
Foreclosure timeline
Set by the court case There is no fixed statutory sale date. Plan refinance or bail-out options early rather than relying on a typical duration.
Rent rules & evictions
No local rent control. State law bars counties and cities from imposing rent controls (Fla. Stat. § 125.0103), and an eviction for unpaid rent starts with a 3-day written notice, excluding weekends and legal holidays (Fla. Stat. § 83.56(3)).
Taxes & closing costs
No state personal income tax (Fla. Const. Art. VII, § 5). Documentary stamp tax applies to deeds (70 cents per $100 of consideration, Fla. Stat. § 201.02) and to mortgage notes (35 cents per $100, Fla. Stat. § 201.08), and a one-time 2-mill nonrecurring intangible tax applies to new mortgages (Fla. Stat. § 199.133). Budget for wind and flood insurance.

FAQ

Florida investor loan questions

How does Florida's judicial foreclosure process affect a bail-out loan?

Because Florida foreclosures go through the courts (Fla. Stat. § 702.01), owners facing a maturing or defaulted loan usually have a window to refinance or bring in short-term capital before a sale. Our Bail Out Funding program provides $50K–$500K, up to 70% of ARV, for 6 months or less.

Can I get a DSCR loan on a Florida short-term rental?

Yes. Short-term rentals are allowed on our DSCR program, but cities and counties set their own vacation-rental rules, so confirm the property can legally be rented short term before you rely on that income.

Can a foreign national finance a Florida rental?

Yes. Foreign National DSCR loans through our lender network require no U.S. credit score or SSN and close in a U.S. LLC.

Does LOANKWEST lend in Florida?

LOANKWEST is a broker, not a lender. We arrange Florida investment property loans through lenders in our network. Availability and terms vary by lender.
