These Terms of Use ("Terms") apply to loankwest.com, including our Spanish (/es/) and Chinese (/zh/) pages, our online applications, calculators, the LoanKwest Assistant chat and our contact and partner forms (together, the "Site"). The Site is operated by LOANKWEST Capital Consultants ("LOANKWEST," "we," "us"). By using the Site, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.
1. We are a broker, not a lender
LOANKWEST is a subsidiary of V Capital Group, LLC. LOANKWEST is a commercial loan broker, not a lender. All loans are made by third-party lenders and are subject to each lender's underwriting, approval, terms and conditions. LOANKWEST does not make credit decisions. AI tools assist our team in matching and processing. Every loan placement is reviewed by a LOANKWEST advisor, and all lending decisions are made by lenders.
2. No offer or commitment to lend
Nothing on the Site is a loan offer, an approval or a commitment to lend. Submitting an application, using a calculator or chatting with the LoanKwest Assistant does not create a loan, a lock or any obligation for you, for us or for any lender. A loan exists only when a lender approves it and you sign that lender's loan documents.
3. Rates, terms and availability
Rates, terms, programs and state availability shown on the Site are representative, vary by lender, and are subject to change without notice. Every loan is subject to the lender's credit approval, underwriting and property review. Not all programs are available in all states. The lender sets the final rate and terms.
4. Calculators, estimates and the LoanKwest Assistant
Our calculators (for example, the DSCR calculator, HELOC line sizing and the joint venture qualifier), funding ranges, sample projections and comparisons are estimates and illustrations based on the numbers you enter and on representative program terms. They are not a guarantee of approval, amount, rate or terms. The LoanKwest Assistant is an automated assistant that gives general information. It is not a loan offer and not legal, tax or financial advice. Confirm anything important with a LOANKWEST advisor and your own advisors.
5. Credit checks
Applying with LOANKWEST doesn't pull your credit. Depending on the program, a lender may ask for your authorization for a credit report later. For GAP Funding, there is only one credit pull, and it happens only after you authorize it.
6. How loans can be used
The loan programs on the Site, including the Rapid Investor HELOC, are business-purpose loans for real estate investment and commercial property. Their applications ask you to certify that the loan proceeds will be used for real estate investment or business purposes, not for personal, family or household purposes.
GAP Funding is the one exception. GAP Funding is offered to real estate investors for business purposes. However, borrowers may use approved funds for any purpose.
Each lender decides which loan purposes and property types it accepts.
7. How we're paid
Broker compensation is disclosed up front and agreed before you commit to a lender.
8. Your responsibilities
- Give accurate, complete and current information, and update us if it changes. Lenders rely on what you provide.
- Submit information about yourself, your business or your property, or about a client only if you're authorized to do so.
- Don't send Social Security, bank account or card numbers through the contact form or chat. Use the secure document portal when we ask for documents.
- Don't misuse the Site. That includes submitting false or automated requests, trying to get into areas you're not authorized to use (including the portal at /login/), interfering with the Site's operation, or copying the Site's content in bulk.
9. Communications
By giving us your contact details and checking the consent box on an application, you agree that LOANKWEST and its lending partners may contact you by phone call, text and email about your request and about your future financing with us. If you choose WhatsApp as your contact method, we may also message you on WhatsApp. Consent is not a condition of any loan. Our SMS Terms explain how texting works and how to opt out.
10. Partner program
Submitting the partner form doesn't obligate you or us to anything. Licensing requirements vary by state, and you're responsible for meeting the requirements that apply to you.
11. Third-party sites and services
The Site links to services we don't control, including our third-party secure document upload portal, WhatsApp, and lenders' own websites and tools. Their terms and privacy policies apply when you use them, and we aren't responsible for them.
12. Intellectual property
The Site and its content, including text, design, calculators, graphics and the LOANKWEST name and logo, are owned by LOANKWEST or its licensors and protected by intellectual property laws. You may view and print pages for your own use in evaluating financing. You may not copy, republish, sell or create derivative works from the Site's content without our written permission. Icons are Solar by 480 Design, used under CC BY 4.0. Third-party photos and trademarks belong to their owners.
13. Disclaimers
The Site and its content are provided "as is" and "as available." We work to keep information accurate, but we don't warrant that the Site is complete, current, error-free or always available, and, to the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
14. Limitation of liability
To the fullest extent permitted by law, LOANKWEST, its parent company and affiliates, and their officers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost deals or lost data, arising from your use of the Site, any estimate or information on it, or any lender's decision, terms or delay. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
15. Governing law
These Terms are governed by the laws of the state in which V Capital Group, LLC is organized, without regard to its conflict-of-law rules. Any dispute relating to the Site may be brought in a court of competent jurisdiction.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we'll change the effective date above. Your continued use of the Site after a change means you accept the updated Terms.
17. Language versions
These Terms are also available in Spanish and Chinese. If a translation differs from the English version, the English version controls.
