Investing in Texas

What's different about investing in Texas

Texas added 562,941 residents between 2023 and 2024, more than any other state, reaching 31,290,831 people (U.S. Census Bureau, Vintage 2024). It also led the country in net domestic migration. For investors in Houston, Dallas–Fort Worth, Austin and San Antonio, that means sustained housing demand and a large supply of rentals, flips and new-construction deals. LOANKWEST is a loan broker, not a lender. One application puts your Texas deal in front of the lenders in our network that fit it.

Foreclosure sales happen on a fixed calendar. Most Texas foreclosures are nonjudicial. A sale under a deed of trust must be a public auction "between 10 a.m. and 4 p.m. of the first Tuesday of a month" at the county courthouse, with notice at least 21 days before the sale (Tex. Prop. Code § 51.002). For buyers, that creates a predictable monthly auction rhythm, which suits fast bridge and hard money capital lined up in advance. For owners with a maturing loan, it means the timeline can be short. Start a refinance or bail out conversation as soon as a default looks possible, not after the notice posts.

There's no personal income tax, by constitution. Since 2019, the Texas Constitution has prohibited a tax on individuals' net income (Tex. Const. art. VIII, § 24-a). Many Texas investors are self-employed or run their portfolios through entities, so qualifying on the property with a DSCR loan rather than on tax returns is often the cleaner path.

Property taxes are local and belong in your underwriting. With no state income tax, local property taxes carry more weight in Texas. Because DSCR is rent ÷ PITIA, the tax bill directly changes whether a rental qualifies. Use the county appraisal district's actual figure in our DSCR calculator, not an estimate from a listing.

Fast growth brings ground-up and land deals. Growth on the edges of the major metros produces lot, spec-home and build-to-rent opportunities. LOANKWEST arranges vacant land loans ($50K–$2M, up to 65% LTV) and ground-up construction (up to 85% of cost and 100% of the build budget).

Top Texas markets for investors

  • Houston Large, affordable single-family rental market; flood-zone status matters for insurance and DSCR.
  • Dallas–Fort Worth Strong corporate relocation demand; active build-to-rent and suburban new construction.
  • Austin Higher price points; value-add and new construction more common than pure cash-flow rentals.
  • San Antonio Lower entry prices and steady rental demand, including military housing near the bases.

Texas foreclosure, rent-rule and closing-cost basics

Foreclosure process
Non-judicial (power of sale) Trustee sales are public auctions held at the county courthouse on the first Tuesday of the month, between 10 a.m. and 4 p.m. (Tex. Prop. Code § 51.002(a)).
Foreclosure timeline
Statutory minimum notice Notice of sale must be given at least 21 days before the sale (Tex. Prop. Code § 51.002(b)); a residence also gets at least 20 days to cure first (§ 51.002(d)). Actual timing varies by lender and file.
Rent rules & evictions
Rent control only in a declared disaster. A city may adopt rent control only after finding a disaster-related housing emergency, with the governor's approval (Tex. Loc. Gov't Code § 214.902). Evictions are heard in justice court (Tex. Prop. Code § 24.004) after at least 3 days' written notice to vacate unless the lease says otherwise (§ 24.005).
Taxes & closing costs
No personal income tax (Tex. Const. art. VIII, § 24-a), and no new real estate transfer tax may be enacted (Tex. Const. art. VIII, § 29). Property taxes are set locally and belong in your DSCR math. Homestead protections (Tex. Const. art. XVI, § 50) cover a person's home, not business-purpose loans on investment property.

FAQ

Texas investor loan questions

How fast do I need to move if my Texas investment loan is in default?

Texas foreclosure sales run on the first Tuesday of the month, with at least 21 days' notice (Tex. Prop. Code § 51.002). Contact an advisor before the notice of sale is posted so there's time to arrange a refinance or bail-out capital.

Can I use hard money to buy at a Texas foreclosure auction?

Many investors line up hard money or bridge financing before auction day. Talk to us early, because terms and requirements for auction purchases vary by lender.

Why do property taxes matter so much for a Texas DSCR loan?

DSCR divides rent by the full payment, including taxes. A higher tax bill raises PITIA and lowers your ratio.
